Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of MyBidTeam, a service provided by Gwinva Ltd ("we", "us", "our"), a company registered in England and Wales.

By using MyBidTeam, you agree to these Terms. If you do not agree, please do not use our service.

2. Service Description

MyBidTeam is an AI-assisted tool that helps users create responses for public sector tender documents. Our service analyses tender requirements and generates draft responses based on information you provide about your business and experience.

Important: MyBidTeam provides assistance only. All generated content should be reviewed, edited, and verified by you before submission. We do not guarantee that using our service will result in successful bids.

3. User Obligations

When using MyBidTeam, you agree to:

  • Provide accurate information about your business and experience
  • Review and verify all generated content before use
  • Take full responsibility for any bid submissions you make
  • Not use the service for any unlawful purpose
  • Not share your account credentials with others
  • Comply with all applicable procurement laws and regulations

4. Intellectual Property

Content you create using MyBidTeam belongs to you. You retain all rights to your business information, case studies, and the bid responses you generate.

The MyBidTeam platform, including its design, code, and AI models, remains our intellectual property. You may not copy, modify, or reverse-engineer any part of our service.

5. Pricing and Payment

MyBidTeam offers multiple pricing tiers. Current pricing is displayed on our website and is subject to change.

5.1 Pricing Tiers

  • Free: Search and browse public sector opportunities at no cost
  • Per-Bid: Pay a one-time fee for AI-generated bid responses for a single tender
  • Unlimited: Annual subscription providing unlimited bid responses for 12 months from purchase

5.2 Founder Pricing

During our launch period, a limited number of customers may access reduced "Founder" pricing. Founder pricing is available to the first 50 paying customers or until 28 February 2026, whichever occurs first. After this period, standard pricing applies to all new purchases.

5.3 "Didn't Win? Next Bid Free" Guarantee

If you use MyBidTeam to generate bid responses and do not win the contract, you are entitled to one free bid generation credit. To claim this:

  • You must report the outcome via our platform within 90 days of the tender deadline
  • You must provide evidence of the unsuccessful outcome (e.g., buyer notification)
  • The free credit applies to your next bid only and cannot be exchanged for cash
  • This guarantee applies to per-bid purchases only, not Unlimited subscriptions

5.4 Credits and Expiry

Promotional credits, referral credits, and "Next Bid Free" credits expire 18 months from the date they are issued. We will send reminder emails before expiry. Expired credits cannot be reinstated.

5.5 Referral Programme

Customers who leave a review may receive a referral code to share. When someone uses your code:

  • The referred customer receives 50% off their first paid bid
  • You receive a 50% discount credit for your next bid
  • There is no limit to how many people you can refer
  • Referral credits expire 18 months from issue
  • You cannot refer yourself or use your own referral code

5.6 General Payment Terms

  • All prices are in GBP and exclude VAT unless stated otherwise
  • Payment is required before generating bid responses (except when using valid credits)
  • Payments are processed securely via Stripe
  • We do not offer refunds for generated content, except where required by law
  • Unlimited subscriptions do not auto-renew unless you opt in

5.7 Consumer Rights

If you are a consumer (purchasing for personal purposes rather than as a business), you have statutory rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, including a 14-day cancellation period for distance contracts.

However, by using our AI generation service, you acknowledge that the digital content will be delivered immediately upon your request. When you click to generate bid responses, you expressly consent to the immediate provision of the service and acknowledge that you will lose your right to cancel once the generation begins, in accordance with regulation 37 of the Consumer Contracts Regulations 2013.

6. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

Tender documents and business information you provide are stored securely and are not shared with third parties except as necessary to provide our service.

7. Limitation of Liability

To the fullest extent permitted by law:

  • We provide the service "as is" without warranties of any kind
  • We are not liable for any unsuccessful bids or lost contracts
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid for the service

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

8. Termination

You may stop using MyBidTeam at any time. We may suspend or terminate your access if you breach these Terms or use the service in a way that could harm us or other users.

Upon termination, your right to use the service ends, but provisions that should survive (such as intellectual property rights and limitations of liability) will continue to apply.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of MyBidTeam after changes take effect constitutes acceptance of the new Terms.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
